Terms of Service

By using ActualWork, you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use the platform.

1. About ActualWork

ActualWork is a shared kanban board for small teams. You create boards, invite people to them, and track work as cards moving between TO DO, IN PROGRESS and DONE. ActualWork hosts that board — we take no part in the work it describes and make no claim about it.

ActualWork is operated by Jon Muller. In these Terms, "we", "us" and "our" mean Jon Muller.

2. Eligibility

  • You must be at least 18 years old to use ActualWork.
  • You must be a human — accounts registered by bots or automated methods are prohibited.
  • By creating an account, you represent that all information you provide is accurate and up to date.

3. Accounts

You are responsible for maintaining the security of your account. You must notify us immediately at support@actualwork.app if you suspect unauthorised access. You are responsible for all activity that occurs under your account.

We may suspend or close an account that breaches these Terms or is used for fraud. We do not close accounts for inactivity.

4. Boards and Cards

  • You are responsible for the content of the boards and cards you create.
  • Board content must be legal and must not violate any applicable laws or regulations.
  • You may not use a board to store illegal material, adult content, or material that harasses another person.
  • ActualWork is not a system of record. Keep your own copy of anything you cannot afford to lose.

5. Board Membership

  • A board owner may invite others as readers or writers, and may change or revoke a member's access at any time.
  • Invitations are claimed by link. Anyone holding a valid, unexpired invite link can join the board it points to, whatever address it was sent to — so treat an invite link as you would a password.
  • Every member of a board can see all of its cards. Do not put anything on a board that you would not show to everyone you have invited to it.

6. Prohibited Conduct

You must not:

  • Use the platform for any unlawful purpose
  • Harass, threaten, or harm other users
  • Post false, misleading, or fraudulent content
  • Scrape, copy, or reproduce platform content without our written consent
  • Attempt to gain unauthorised access to any part of the platform
  • Use the platform to spam, advertise, or solicit users for unrelated services

7. Intellectual Property

ActualWork and its features and functionality are owned by us and protected by applicable intellectual property laws.

You keep ownership of everything you put on a board. You grant us a non-exclusive, royalty-free licence to host, store, back up and display that content for the sole purpose of running ActualWork — showing it to you and to the other members of the boards you put it on, and to no one else. We may sublicense that only to our infrastructure providers, and only so they can do the same on our behalf. The licence ends when you delete the content or close your account.

8. Disclaimers and Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified. Where the Australian Consumer Law applies and permits us to limit our liability for failing to comply with a consumer guarantee, our liability is limited, at our option, to resupplying the service or paying the cost of having it resupplied.

Subject to the paragraph above, ActualWork is provided on an "as is" basis. We do not warrant that the platform will be uninterrupted, error-free, or that results will meet your expectations.

Subject to the first paragraph of this section, and to the maximum extent permitted by law, ActualWork is not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including loss of board content or unavailability of the service.

9. Indemnification

You agree to indemnify us against claims, damages and expenses (including reasonable legal costs) arising from your breach of these Terms, the content you put on a board, or your unlawful conduct. This does not apply to the extent a claim arises from our own act, omission or breach, and nothing in this section requires you to indemnify us for anything the Australian Consumer Law does not permit.

10. Changes to These Terms

We may update these Terms. For a material change we will post a prominent notice on the platform at least 30 days before it takes effect and update the date at the top of this page. If you do not accept a change, you can stop using ActualWork and close your account before it takes effect. Changes are not retrospective.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
